Who pays for pest control in a Florida rental?

Nearby Neighborhoods

There is no flat rule, and anybody who gives you one is guessing. Section 83.51, Florida Statutes requires the landlord to make all repairs and keep the premises fit and habitable for the whole tenancy, and that duty cannot be waived. Tenant duties sit in section 83.52, Florida Statutes. Who pays a given invoice still turns on the lease and on the cause.

What section 83.51, Florida Statutes says

The Florida Residential Landlord and Tenant Act sits in Part II of Chapter 83 of the Florida Statutes. Section 83.51 requires the landlord to make all repairs and do whatever is necessary to put and keep the premises in a fit and habitable condition. That duty runs for the whole tenancy, not only at move-in, and the landlord's duties cannot be waived.

Tenant duties are set out separately in section 83.52, Florida Statutes. Neither section prints a price list for pest control, which is why the honest answer is that it turns on the lease and on the cause. Anyone telling you the statute settles the invoice has not read it.

Three habits that keep a tenant on strong ground

Report the problem in writing and keep a copy, even if you also called. Do not damage the premises. Do not stop paying rent, whatever else is going on. That is the short version of the FL Bar's own consumer guidance, and it is what keeps a disagreement simple.

Dates do more work than adjectives ever will. A written note recording what you saw, whereabouts, and when, beats a phone call nobody wrote down.

Rental disputes here don't stay confined to one zip code, since the licensed pros we connect you with take calls from renters as far out as Panacea and Sopchoppy, not just inside Tallahassee proper. A tenant near the Sopchoppy River dealing with a landlord who won't return calls faces the same documentation gap as one off US 98 toward Ochlockonee Bay. Keep copies of every note before handing anything over, whether the unit sits near Chattahoochee or closer to town.

Why landlords around here often carry it regardless

Leon County holds an unusual amount of rental stock for its size, and most of it moves on the academic calendar. A building can empty in a week in April and refill in a week in August. A quarterly program on the building usually costs less than arguing about one roach call per turnover, and it produces a service record that answers the argument before it starts.

Multi-unit work has a physical reason for being building-wide as well. Roaches and bed bugs move through shared walls and plumbing chases, so treating a single unit and billing a single tenant generally just relocates the problem next door.

Short-term and vacation rentals are a different arrangement

Part II of Chapter 83 governs residential tenancies. A short-term let is a different arrangement and the same reasoning should not be assumed to carry over, so read the agreement rather than the statute. Nothing here is legal advice; for a dispute about a specific lease, talk to a lawyer.
